The experience of dealing with the socio-economic consequences of the Covid-19 pandemic and the war in Ukraine confirms the thesis that decisions on financial assistance must be taken without delay and that the government must have a certain degree of freedom and flexibility to act. However, do emergencies entitle governments to bypass the principles of responsible and transparent fiscal policy-making? Do the challenges countries face in dealing with the effects of the Covid-19 pandemic and the war in Ukraine also legitimise governments' furthering of the debudgetisation of public finances? This article aims to answer these questions. The background of the considerations will be an analysis of Polish legal solutions and systemic practice. First, it is worth noting that anti-crisis measures in Poland have been taken primarily through extra-budgetary financial instruments, which are not included in the monitored scope of public finance. Surprising budgetary solutions appear, such as transferring Treasury securities instead of subsidies or pushing certain expenditures outside the state budget, to circumvent regulations and legally binding restrictions. In the context of parliamentary scrutiny, this means that a significant proportion of public debt is outside parliamentary control, and the scale of circumvention of the constitutional limit on public debt has been increasing for several years, reaching a considerable percentage of the GDP in 2021. This phenomenon is also accompanied by a record increase in public debt, fuelled by borrowing to finance tasks related to countering the Covid-19 pandemic and the socio-economic consequences of the war in Ukraine. It is, therefore, worth taking a closer look at the Polish government's budgetary solutions, which undoubtedly do not contribute to fostering transparency in budgetary policy.

In the light of the standards of the International Organisation of Supreme Audit Institutions (INTOSAI) the basic principles for the functioning of the supreme audit institution should be laid down in a constitution which guarantees their stability. In this respect, it is proposed that constitutional provisions should lay down the basic principles for the functioning of supreme audit institutions, including, inter alia, the procedure for their establishment, the procedure for the appointment and dismissal of chairpersons and members of the institution concerned, basic powers and auditing responsibilities, reporting obligations and institutional guarantees of the functional and organisational independence of the authority. This article aims to analyse the constitutional regulations of the EU Member States to guarantee the independence of Supreme Audit Institutions. ; Gwarancje niezależności najwyższych organów kontroli w państwach członkowskich UE – analiza prawnoporównawcza. The judges form a special legal corps which as a carrier of the authority of the judiciary has to fulfill an extremely important mission both systemically and socially. The power vested in them is in fact closely connected to such universal values as justice, freedom or equality. The public interest in maintaining citizens' trust in the institutions of the judiciary obliges the legislator to establish certain ethical requirements for the judges. They are to ensure that the judiciary is in the hand of people with appropriate knowledge, high ethical standards and proper dose of life experience. The aim of the article is to review and discuss Polish regulations regarding the ethics of the profession of a judge, with particular emphasis on such concepts as: the independence of the judiciary, the dignity of the judge's office or the "impeccability of character" of the judge. ; Sędziowie tworzą szczególny korpus prawniczy, który jako nośnik autorytetu wymiaru sprawiedliwości, ma do spełnienia wyjątkowo ważną ustrojowo i społecznie misję. W 2014 r. brytyjska Izba Lordów, duński Folketing oraz niderlandzka Izba Druga zainicjowały na forum Konferencji Komisji do Spraw Unijnych Parlamentów Unii Europejskiej (COSAC) debatę dotyczącą roli parlamentów narodowych w europejskim procesie decyzyjnym. Choć przedłożone przez poszczególne izby raporty istotnie się różnią, przyświeca im jednak wspólny cel. Postulują one bowiem podjęcie szeregu inicjatyw mających na celu wzmocnienie mechanizmu kontroli zasady pomocniczości, w tym przede wszystkim w zakresie szerszej współpracy pomiędzy parlamentami narodowymi. Ważną rolę w procesie umacniania roli parlamentów narodowych w UE może także odegrać w przyszłości procedura tzw. zielonej kartki, która w założeniu jej pomysłodawców przyczyni się do większego zaangażowania krajowych ciał ustawodawczych w prace legislacyjne już na etapie prac przygotowawczych w Komisji Europejskiej. ; After and even in the run-up to the ratification of the Lisbon Treaty, national parliaments have implemented new procedures to apply the instruments in practice. However, five years from the entry of the Lisbon Treaty into force, national parliaments are still evaluating the means of their influence and control over the EU law and policies. National parliaments would determine their own position and contribute to further development in the European cooperation by becoming more actively involved in the decision-making of the European Union. Not just as the guardians of the subsidiarity principle, granted the possibility to block and delay draft laws, but also as proactive players in a constructive sense, with a right to invite the European Commission to table legislative proposals either to create new legislation or to amend the existing one. The role of national parliaments can be increased if they as such have more influence on the content of legislation. ; Nel 2014 nuove idee e proposte sul ruolo dei parlamenti nazionali nel processo decisionale europeo sono state avanzate da molti parlamenti nazionali (del Folketing danese, della House of Lords britannica e della Tweede Kamer olandese) e dal Parlamento europeo. Benché le relazioni del Folketing danese, della House of Lords britannica e della Tweede Kamer olandese differiscano nei contenuti, si possono comunque riscontrare alcune somiglianze. In particolare, tutte e tre le camere ritengono che i parlamenti nazionali debbano avere un ruolo più proattivo, e in particolare debbano poter suggerire alla Commissione di presentare nuove proposte. Tutte e tre le relazioni sottolineano che il crescente coinvolgimento dei parlamenti nazionali nella fase prelegislativa è necessario per influire sulle proposte presentate dalla Commissione ("Carta verde").
